Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Kidzen platform (the "Service") operated by SYREN STACK COMPANY LIMITED ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using any part of the Service, you confirm that you are at least 18 years old, have the authority to enter into this agreement on behalf of your organization, and agree to comply with these Terms and all applicable laws and regulations.

2. Description of Service

Kidzen is a cloud-based management platform designed for preschools and kindergartens. The Service includes, but is not limited to:

  • School administration dashboard (student management, attendance, scheduling, fees)
  • Parent communication application
  • Facial recognition check-in/check-out system
  • AI-powered chatbot for parent support
  • Reporting and analytics tools

3. Account Registration

To access the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account credentials confidential. You are responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

4. Subscription and Payment

Access to the Service is provided on a subscription basis. Pricing is based on the number of enrolled students and the modules selected. All fees are non-refundable unless otherwise stated in your subscription agreement.

We reserve the right to change our pricing at any time. We will provide at least 30 days' notice before any price change takes effect for existing subscribers.

5. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for ensuring that your use of the Service complies with all applicable data protection laws, including obtaining any necessary consents from parents or guardians before entering children's personal data into the platform.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any regulations
  • Upload or transmit any content that is harmful, offensive, or infringes third-party rights
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Use the Service to store or process sensitive personal data beyond what is necessary for school management
  • Resell, sublicense, or transfer your access to the Service to any third party

7. Intellectual Property

All intellectual property rights in the Service, including software, design, trademarks, and content created by us, remain the exclusive property of SYREN STACK COMPANY LIMITED. Nothing in these Terms grants you any rights in the Service other than the limited right to use it as described herein.

You retain ownership of all data and content you upload to the Service ("Your Data"). You grant us a limited license to process Your Data solely for the purpose of providing the Service.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice, and we are not liable for downtime caused by circumstances beyond our reasonable control.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or business opportunities, arising out of or in connection with your use of the Service.

Our total liability to you for any claim arising under these Terms shall not exceed the total fees paid by you to us in the three months preceding the claim.

10. Termination

Either party may terminate the subscription at the end of the current billing period by providing written notice. We may terminate or suspend your access immediately if you materially breach these Terms.

Upon termination, you may request an export of Your Data within 30 days. After that period, we may delete Your Data in accordance with our data retention policies.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or via an in-product notification at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Socialist Republic of Vietnam. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in Ho Chi Minh City, Vietnam.
